Action in the Ramsey County District Court for personal injuries to plaintiff allegedly resulting from the negligence of defendant, Cincinnati Corporation, in the manufacture of certain machinery. Said defendant filed a third-party complaint against Hutchinson Manufacturing and Sales, Inc., which was the employer of plaintiff. The case was tried before Edward D. Mulally, Judge, and a jury, which found in a special verdict that all of the parties were causally negligent; that the negligence attributed to each was plaintiff, 15 percent, defendant, 25 percent, and third-party defendant, 60 percent; and that plaintiffs damages were $40,000. The court ordered judgment for plaintiff for $34,000 against defendant and judgment in favor of third-party defendant. Defendant appealed from an order denying its motion for a new trial and from the judgment entered.
